Terms of Service

1. Purpose

These Terms govern your use of pickcam (the “Service”), operated by Gilbreth(“we”, “us”). They set out the rights and obligations of both you and us.

2. What the Service does

You upload a video of a group performance. The Service detects and tracks each person in it and produces one vertical (9:16) clip per person. Results are returned to you only. We do not publish them or make them available to anyone else.

  • Paid: download of the clean, high-definition result

3. Accounts

You can start without signing in; an anonymous session is created for you. To view and keep your results you must sign in with Google. Work created before you signed in is transferred to that account. You are responsible for the security of your account.

4. Your obligations and warranties

By uploading a video you warrant that:

  1. you own the copyright in it, or hold a valid licence to use it;
  2. you have obtained the consent of every person appearing in it, both to being filmed and to processing through this Service;
  3. the video does not infringe any third party's rights, including rights in any music it contains.

You must not:

  • upload material that is unlawful or infringes anyone's rights;
  • upload child sexual abuse material, non-consensual intimate imagery, or synthetic sexual imagery (deepfakes);
  • upload footage of a person filmed without their consent;
  • interfere with the normal operation of the Service, or access it by automated means.

If a third party brings a claim against us in connection with a video you uploaded, you will defend us at your own cost and indemnify us for any loss we suffer, including reasonable legal fees.

5. Rights in your content

You keep all rights in the video you upload and in the results generated from it. We take only the licence we need to run the Service (storing, transmitting, extracting frames, tracking people, generating the clips), and we do not use your content for marketing, promotion, or to train AI models.

6. Payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices and applicable taxes are shown at checkout, and you can review and correct your order before paying.

7. Refunds and withdrawal

You may withdraw from a purchase within 7 days. However, under Article 17(2)(5) of Korea's Act on Consumer Protection in Electronic Commerce, the right to withdraw does not apply to a high-definition result once its download has begun.

So that this limitation is valid, we (1) state clearly at checkout that withdrawal is unavailable once the download starts, and (2) provide a free watermarked preview beforehand so you can judge the result. Results you have not started downloading can still be withdrawn from.

Loss or damage to a result caused by you, and dissatisfaction with the accuracy of automatic tracking, are not grounds for withdrawal. Refunds are issued to the original payment method within 3 business days of a valid withdrawal. Contact Paddle or support@pickcam.app. Statutory withdrawal periods in your country of residence apply if they are longer.

8. Copyright complaints and takedown

If you believe content on the Service infringes your rights, send us a substantiated notice and we will suspend the reproduction and transmission of that content without delay, and notify both you and the uploader, in accordance with Article 103 of Korea's Copyright Act. The uploader may request reinstatement by showing they hold the necessary rights.

We may terminate the account of anyone who repeatedly infringes the rights of others. We have no obligation to monitor or actively search the Service for infringing material.

9. Temporary suspension of content

Where content is reported as infringing another person's rights, we may block access to it for up to 30 days under Article 44-2 of Korea's Network Act.

10. Changes, suspension, and restriction of use

We may change the Service and the limits of its free tier, and may discontinue it in whole or in part. Any change adverse to a paid service is announced in advance under section 13.

Where we have reasonable grounds to believe you have breached section 4, we may refuse to process your content, delete it, and after notice suspend or terminate your account. Where urgent action is required, for example for criminal content, we may act first and notify you afterwards. You may delete your account at any time.

11. Storage and backup

We do not guarantee that your uploads or results will be stored permanently. You should download and keep what you need. Except in cases of our wilful misconduct or gross negligence, we are not liable for data lost through account termination, discontinuation of the Service, or the failure of a third-party storage provider.

12. No warranty and limitation of liability

The Service is provided as-is. The accuracy of automatic person tracking depends on the resolution, lighting, spacing and costume similarity in your source video. We do not warrant any particular level of accuracy, fitness for a particular purpose, or uninterrupted availability.

We are not liable for loss caused by events outside our reasonable control, including force majeure, your own fault, or the failure of a third-party service. Nothing above excludes our liability for our own wilful misconduct or gross negligence.

To the extent permitted by law, our total liability is limited to the amount you actually paid us in the six months before the loss arose, and we are liable for special, indirect or consequential loss only where we knew or should have known it might occur. Nothing in these Terms limits any right you have as a consumer that cannot be excluded by the mandatory law of your country of residence.

13. Changes to these Terms

We may amend these Terms. We will post the amended Terms, the effective date and the reason for the change on the Service at least 7 days beforehand, and at least 30 days beforehand, with individual notice by email, where the change is adverse to you. If you do not accept a change you may close your account.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Korea. Disputes may be brought before the court having jurisdiction under the Korean Civil Procedure Act. If you are a consumer, nothing here deprives you of the protection of the mandatory consumer law of the country where you habitually reside, and you may bring proceedings in the courts of that country where its law so provides.
